Terms of Service

By accessing turbomindz.com, the TURBOMINDZ mobile applications, or posting in the TURBOMINDZ community forum, you agree to these Terms of Service. If you do not agree, please do not use the service.

TURBOMINDZ is a phygital philosophical art project operated by Hugo Gaona (“TURBOMINDZ,” “we,” “us”). For privacy practices see /privacy.

The TURBOMINDZ service includes:

• The turbomindz.com web experience (browse, learn, optionally subscribe).
• The TURBOMINDZ iOS and Android apps (browse + community access), planned for a later release.
• The weekly Field Journal letter (if you subscribe).
• The on-site community forum (if you post).
• Two NFT collections on Polygon — Inception (1,150 scenes) and Off the Map (737 scenes), 1,887 in total. NFTs are sold on OpenSea. Purchases happen on OpenSea or the web (turbomindz.com), not within the mobile apps.
• The optional marriage system — pairing a physical artwork you own to a TURBOMINDZ NFT. Open; see §8.
• Turbomindz Agency — fixed-price creative services (branding, websites, video, content) and monthly plans, sold on this site. See §3a.

When you buy a service engagement or a monthly plan from the agency pages, these terms apply to that engagement:

• One fixed price, paid up front. The price on the service page is the price at checkout (processed by Stripe); there are no surprise additions within the agreed scope.
• Unlimited revisions within scope. We revise the deliverable until you are genuinely happy with it. A change of scope (a new deliverable, a different service) is a new order, and we will say so before any work starts.
• Nothing ships until you approve it. Work is released to you through an explicit approval step; your approval is what completes a milestone.
• One-time projects: full refund at the first concept. If we are not aligned when the first concept lands, you may cancel there for a full refund of that engagement.
• Monthly plans up to $997: the first month is refundable. A monthly plan has no “first concept” to be aligned at, so the protection works differently. On plans priced up to $997 a month, if the first two weeks are not working, tell us and we refund that whole month. Above that price the protections are the approval step and the exit: you approve every deliverable before it ships, and you can pause or cancel before the next cycle.
• Your deliverables are yours. On full payment, ownership of the final deliverables produced for your engagement — files, accounts and credentials created for you — transfers to you. §7’s copyright reservation covers the TURBOMINDZ story-world art, not your project deliverables.
• Subscriptions bill monthly at the stated price and can be paused or cancelled anytime from your account; cancellation stops the next cycle.
• Support. Client-project questions get a reply within one business day via /agency/contact or the phone number published there. The 7-day window elsewhere in our docs is for community and collection matters, not client projects.

We do not offer investment advice. NFTs from TURBOMINDZ are digital art collectibles tied to philosophical content. Their value may go up, down, or to zero. Past performance is not indicative of future returns. You alone are responsible for understanding the risks of buying, holding, and trading digital assets.

By minting or buying a TURBOMINDZ NFT you receive: ownership of the tokenized art, an automatic Founding Witness role in the community forum, and eligibility to apply for marriage as described in §8. You do not receive any equity, security, profit-sharing, or fiduciary claim on the project, its operators, or any future revenue.

TURBOMINDZ uses thirdweb’s wallet connection (with optional embedded wallets via email/Google sign-in). We never see, store, or have access to your private keys. You are solely responsible for your wallet’s security, backup, and recovery. We cannot recover lost wallets, reverse transactions, or refund mistakes you make on-chain.

You agree NOT to:

• Use the service for illegal activity.
• Attempt to exploit smart contracts beyond their intended use.
• Spam, harass, or abuse other community members in the forum or comments.
• Reverse engineer, scrape, or repurpose our content for derivative commercial works without permission.
• Misrepresent your wallet ownership (e.g., faking a Founding Witness badge).
• Use TURBOMINDZ to facilitate money laundering, sanctions evasion, or other financial crimes.

We may suspend or remove access (forum ban, wallet block at the app layer) for violations. On-chain ownership cannot be revoked — those are permanent regardless of community standing.

All TURBOMINDZ-original art, lore, character designs, the four travelers (Cosmo, Nova, Stella, Luna), the village concept, and written essays are © TURBOMINDZ / Hugo Gaona. All rights reserved.

NFT holders receive a limited, personal, non-exclusive, non-transferable license to display the specific artwork they own. This includes: posting to your social media, printing for personal display, using as your profile picture. It does not include: selling merchandise featuring the art, using the art in derivative commercial works without our written permission, or claiming the underlying IP.

Quotes from public-domain philosophers are used under fair use / public-domain rules. Quotes from living authors are used under fair use within a transformative artistic context.

The marriage system is open. Any holder may apply at /marriage/submit. Applying is free — there is no fee. A marriage is an optional pairing of one physical artwork you own with one TURBOMINDZ NFT: on approval the evidence is pinned to IPFS and the bond is recorded on-chain, publicly viewable. Treat the pairing as permanent.

Every application is reviewed by a person, normally within 7–14 days. We may ask for further photographs or proof of ownership, and we may decline any application at our discretion — a decline is not an accusation, only a judgement that provenance could not be established well enough to record.

What may be married, the provenance declaration you sign, and the rules of the marketplace where married pairs may be listed are set out in the Community, Marriage & Marketplace Rules, which are incorporated into these Terms. In short: the work must be yours to commit, original, physical and specific, lawful and documentable, and any AI assistance must be disclosed.

By submitting an artwork for marriage, you affirm you own the rights to share it publicly. We may reject submissions that violate community standards (illegal, abusive, infringing). A false provenance declaration voids the marriage and forfeits listing rights. Only Turbomindz Studio can void a bond, and only on those grounds — there is no holder-initiated dissolution and no cooling-off period. Where we void one, we will record it publicly and tell the holder why.

Where a married pair is offered for sale, Turbomindz operates the venue, not the escrow. Settlement of the NFT happens on the secondary marketplace, and physical delivery, shipping, insurance and any taxes are between buyer and seller unless a listing says otherwise.

Per Apple App Store policy and Google Play policy, the TURBOMINDZ mobile apps offer browse / view / community features only. NFT minting and purchase happen on the web (turbomindz.com) — the apps may link to the web for any transaction. This is a platform requirement, not our preference. The web app remains the canonical experience.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. We make no guarantees about uptime, NFT value, smart-contract behavior under all conditions, or third-party services we depend on (Polygon network, IPFS, OpenSea, Stripe, Buttondown, Supabase, Vercel, Pinata, thirdweb).

We are not responsible for: blockchain network issues, lost wallets, smart contract exploits we did not cause, third-party marketplace policies (OpenSea takedowns, etc.), or app store removal.

To the maximum extent permitted by law, TURBOMINDZ’s total liability for any claim arising out of or related to the service is limited to the amount you paid us in the 12 months prior to the claim — or $100 if you paid nothing.

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or lost opportunities.

We may update these Terms. The “Last updated” date above changes when we do. Material changes are announced via email subscribers and the forum. Continued use after a change means you accept the new Terms.

These Terms are governed by the laws of the United States and the state in which Hugo Gaona is domiciled. Any dispute will be resolved via binding arbitration except where prohibited. You waive class action rights to the extent permitted by law.
